Terms of Service

1. Acceptance of the terms

By opening an account, starting a trial, subscribing or otherwise continuing to use MojPorat, you accept these terms. If you use MojPorat on behalf of a company or sole trader, you confirm you have the authority to bind that entity. If you use it as an individual, you confirm you are of legal age and have the capacity to enter into this agreement.

2. The service

MojPorat is a subscription app that lets private hosts manage reservations, availability, seasonal pricing, guest registration data, turnovers and cleaning, expenses, and a public booking page. Access is granted according to the plan you choose, and pricing is charged per property (a house, villa or building at one address), with an unlimited number of rental units within each property.

We grant you a limited, non-exclusive, non-transferable right to use MojPorat within your chosen plan. Reverse engineering, resale or further distribution of access is not permitted, nor is circumventing technical or plan limits.

3. Your account and your data

• You must enter accurate account and property information and keep it up to date.
• You are responsible for safeguarding your login credentials and for all activity under your account.
• You are responsible for the guest, reservation and registration data you enter, including its lawful collection and accuracy in filings such as eVisitor and tourist tax calculations. MojPorat helps you prepare and submit this data but does not replace your legal obligations as a host.
• You grant us a limited licence to store and process your content solely to provide and operate the service.

4. Acceptable use

You must not misuse MojPorat. In particular you must not:

• use the service for unlawful purposes or in breach of Croatian or EU law;
• use it for fraud, spam, or mass messaging guests without consent;
• infringe others' intellectual property rights or upload content you have no right to use;
• compromise the security or integrity of the service — malware, vulnerability testing without written permission, automated scraping, or attempts to access other users' data.

5. Intellectual property

We retain ownership of MojPorat and all its parts: code, design, documentation, guides and branding. Nothing in these terms transfers our intellectual property to you. You retain ownership of your own data and content.

6. Service availability

We work to keep MojPorat available and accurate, but we do not guarantee uninterrupted, error-free operation. Maintenance, outages of third-party services (such as sales channels or eVisitor) and events outside our reasonable control may affect availability. To the maximum extent permitted by law, we exclude implied warranties, including merchantability and fitness for a particular purpose.

7. Payment, subscription and taxes

The subscription is monthly and charged per property: €9.99 for one property, €19.99 for up to three properties, and €6.99 for each additional property. New accounts get a 14-day free trial; when the trial ends without a subscription, the account switches to read-only mode, and your data is preserved.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer service inquiries related to billing and processes refunds. Billing, renewal, cancellation, taxes and refunds are governed by Paddle's buyer terms in addition to these terms and our refund policy.

If you cancel your subscription, you keep full access until the end of the period you paid for, after which the account switches to read-only mode. If a renewal charge fails, you keep access during the retry period before switching to read-only mode.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security risk or suspected fraud, and for repeated or serious policy violations. Where feasible, we will warn you beforehand. After termination you can export your data within 30 days, after which it may be deleted.

9. Liability

To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the claim arose. We exclude indirect, consequential and special damages, including lost profits, lost bookings, data or reputation. Nothing excludes liability for fraud, death or personal injury caused by negligence, or liability that cannot be excluded by law. You will indemnify us for claims arising from your content, unlawful use of the service, or breach of these terms.

10. Final provisions

These terms are governed by Croatian law, and the courts of the Republic of Croatia have jurisdiction over disputes, unless mandatory consumer-protection rules in your country provide otherwise. You may not transfer these terms without our consent; we may transfer them as part of a merger or acquisition. We may amend these terms, and we will notify you of material changes in the app or by email before they take effect.
